Think you will be “exempt” from FSMA? You may need to think again!


An urgent message from UVM-Extension's Ginger Nickerson: Although the Food Safety Modernization Act (FSMA) rules exempt smaller businesses based on gross sales, farms or food businesses that think they are exempt from the rules, may need to comply with the rules as they are currently proposed.

  • If you are a diversified farm that sells produce and your total gross sales from all human and animal food(this includes sales from: hay, maple syrup, exempt produce, cooked foods, and USDA inspected meat) is over $500,000, you will be covered by the rules.
  • If over half of your sales are to distributors or wholesale markets, you may be covered by the rules
  • If you process, or do value-added (such as peeling squash) you may be subject to the Preventive Controls rules
  • If you buy in and sell product from other farms you may be subject to the Preventive Controls Rules
  • If you store crops for winter markets you may be subject to the Preventive Controls Rule
